DMCA Notice & Takedown Policy

1. Introduction

Ubifans (“we”, “our”, “us”) respects the intellectual property rights of others and expects all creators and users on our platform to do the same.

This DMCA Notice & Takedown Policy explains how copyright owners may request the removal of infringing material appearing on Ubifans.com and how users may file a counter-notification if they believe a takedown was made in error.

We comply with the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512.


2. Designated DMCA Agent

All copyright notices must be sent to our designated agent:

3. Filing a Valid DMCA Takedown Notice

If you believe that content on Ubifans infringes your copyright, you may request removal by sending us a written notice that includes all of the following:

  1. A physical or electronic signature of the person authorized to act on behalf of the copyright owner.

  2. Identification of the copyrighted work claimed to have been infringed.

  3. Identification of the infringing material on Ubifans that you want removed, including direct URLs or any information that allows us to locate the material.

  4. Your contact information, including your name, address, telephone number, and email address.

  5. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.

  6. A statement that the information in the notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner.

DMCA notices that lack any required information may be rejected.


4. Removal of Content

Upon receiving a valid DMCA notice, Ubifans will:

  • Remove or disable access to the allegedly infringing material.

  • Notify the creator who posted the content.

  • Record the takedown internally for compliance purposes.

Creators who repeatedly violate this policy may have their accounts suspended or permanently banned.


5. Filing a DMCA Counter-Notification

If your content was removed because of a DMCA notice and you believe it was done in error or that you have the legal right to post the material, you may submit a counter-notification.

Your counter-notification must include:

  1. Your physical or electronic signature.

  2. Identification of the removed material and where it appeared before removal.

  3. A statement under penalty of perjury that you believe the material was removed due to mistake or misidentification.

  4. Your full name, address, telephone number, and email address.

  5. A statement that you consent to the jurisdiction of the courts in your country of residence, and that you will accept service of process from the original complainant.

Counter-notifications should also be sent to:

Once we receive a valid counter-notification, we will forward it to the original complainant and restore the material within 10–14 business days, unless the complainant notifies us that they have filed a court action to prevent restoration.


6. Repeat Infringer Policy

Ubifans terminates accounts of users who are found to be repeat infringers under the DMCA.
We may also restrict account functionality if we receive multiple valid copyright complaints against a user.


7. Misuse of DMCA Procedures

Submitting false DMCA notices or counter-notices may result in legal liability.
Ubifans reserves the right to take action against users who knowingly misuse or abuse the DMCA process.
